Terms and Conditions for WP Optimal State

1. Introduction

Welcome to WP Optimal State. These Terms and Conditions (“Terms”) govern your purchase and use of the “WP Optimal State” premium WordPress plugin (the “Plugin”), sold by The Spiritual Seek (“Seller,” “we,” “our,” or “us”), located at via Roma, Italy.

By purchasing, downloading, installing, or using the Plugin, you (“User,” “you,” or “your”) agree to be bound by these Terms. If you do not agree with these Terms, you must not purchase, download, or use the Plugin.

2. Description of Service

WP Optimal State is an advanced WordPress optimization suite developed by Luke Garrison and his collaborators. Its features include, but are not limited to, integrated database cleanup, database backup and restore tools, page caching, and various performance and diagnostic tools.

It comes in two versions: FREE and PRO. The PRO version is licensable upon purchase.

Your purchase provides you with a license to use the Plugin, which includes access to future updates and support as outlined in these Terms.

3. License

  • Plugin Code License: The PHP code of the WP Optimal State plugin is licensed under the GNU General Public License (GPL) v2.0 or later, as declared in the plugin’s header files.
  • Lifetime License (Updates & Support): Your one-time purchase of $105.00 grants you a Lifetime License for one website. This “Lifetime License” specifically entitles you to:
  • Receive all future updates for the Plugin.
  • Receive priority email support.
  • Definition of “Lifetime”: “Lifetime” is defined as the entire period during which the WP Optimal State product is actively developed, supported, and sold by The Spiritual Seek. Should The Spiritual Seek cease development and sale of the Plugin, the lifetime license for updates and support will end at that time.

4. Payment and Delivery

  • Price: The price for the Lifetime License is $105.00 per site.
  • Installation Service: Along with Lifetime License, you can also purchase the installation service for a combined price of $145.00. After purchase, you will be contacted by our staff, asking you for your WordPress login credentials. You will be notified promptly once installation is complete; for security reasons, change your login password immediately afterwards.
  • Payment: This is a one-time payment. All payments are processed through our secure third-party payment gateway.
  • Delivery: After your payment is successfully processed, you will receive an email confirmation containing a download link for the Plugin and your unique license key.
  • Updates: You will receive an email notification at the address used during checkout whenever an update is available. You will find the updated package ready for download in your personal account on the purchase website (Payhip.com).

5. Support Policy

Your Lifetime License includes priority email support. You will be asked for your license key and website URL in order to receive support.

  • Scope of Support: Support is limited to assistance with Plugin features, bug fixes, and general setup questions related to the Plugin’s functionality.
  • Exclusions: Support does not include:
  • General WordPress support or administration.
  • Conflicts with or support for third-party themes or plugins.
  • Website customization or custom code modifications.
  • Server or hosting configuration issues.

6. Refund Policy

We offer a 14-day, no-questions-asked money-back guarantee.

If you are unsatisfied with the Plugin for any reason, you may request a full refund within 14 days of your original purchase date. After 14 days, no refunds will be granted. By requesting and receiving a refund, your license key will be deactivated, and you will no longer receive plugin updates or support.

7. Limitation of Liability and Disclaimer of Warranty

This section is critical due to the nature of the Plugin.

  • Inherent Risks: The Plugin is a powerful tool that performs advanced database operations (including cleanup and restore) and can modify server files (such as .htaccess). These are high-risk actions that can, if used incorrectly or in an incompatible environment, lead to data loss, website downtime, or critical website errors.
  • User Responsibility: You expressly agree to create and verify a complete and restorable backup of your website’s files and database before installing or using the Plugin, and especially before performing any cleanup, restore, or optimization action. The Plugin’s interface explicitly encourages this by providing a backup tool.
  • “As-Is” Provision: The Plugin is provided “as-is” and “as-available,” without any warranty, express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • No Liability: To the maximum extent permitted by applicable law, in no event shall The Spiritual Seek be liable for any direct, indirect, incidental, special, consequential, or exemplary damages (including, but not limited to, loss of data, loss of profits, site crashes, or business interruption) arising from the use of, or inability to use, the Plugin, even if we have been advised of the possibility of such damages.

8. Intellectual Property

All trademarks, logos, and brand assets associated with “WP Optimal State” and “The Spiritual Seek” are the exclusive property of The Spiritual Seek. The GPL license (see Section 3) pertains to the plugin’s PHP code but does not grant you any rights to use our branding or trademarks.

9. Governing Law and Jurisdiction

These Terms, and any dispute arising from them, shall be governed by and construed in accordance with the laws of Italy.

Any legal action or proceeding relating to your purchase or use of the Plugin shall be subject to the exclusive jurisdiction of the courts of Rome, Italy.

10. Amendments

We reserve the right to modify these Terms and Conditions at any time. We will notify users of any significant changes. Your continued use of the Plugin after such changes constitutes your acceptance of the new Terms.
